Terms & Conditions

1. These terms and conditions, together with our Privacy Policy (collectively “Agreement”) set forth the general terms and conditions of your participation in the Terokai Khazanah Malaysia (Discover Malaysia’s National Treasure) Contest 2024 (“TKM”). By using this website and participating in the TKM, you agree to accept the terms and conditions of the Agreement and the Agreement shall constitute a legally binding agreement between you (“you” or “your”) and Khazanah Nasional Berhad (“Khazanah”, “we”, “us” or “our”). You shall ensure and represent that your participation in the TKM is lawful in accordance with applicable laws and Khazanah shall not be taken to make any representation, express or implied, as to the lawfulness of your participation.
2. Eligibility:
   1. The TKM is open to all Malaysians of age 18 and above, except employees of Khazanah and their immediate family members.
   2. You must follow Khazanah’s official Instagram account to enter.
   3. You shall only participate in the TKM in your own individual capacity and identity. Participation in the TKM on behalf of another individual is prohibited.
3. Categories: There are three (3) categories for the TKM:
   1. Cultural Treasures: Food, art, dance, music, traditional crafts, festivals, etc.
   2. Natural Treasures: Scenic landscapes, biodiversity, environmental initiatives.
   3. Historical Treasures: Significant landmarks, historical sites, artifacts.
4. Indicative timeline: Subject always to the discretion of Khazanah, the TKM indicative timeline shall be as follows:

   Event	Date
   Start Date	12th May 2024, or any other date to be determined by Khazanah
   Submission Period	6 weeks from Start Date
   Judging Period	1-2 weeks from end of Submission Period
   Winner Announcement	8th July 2024 , or any other date to be determined by Khazanah

   Submissions received past the Submission Period shall not be accepted for review and shall be deemed ineligible for participation in the TKM. The winner of the TKM shall be announced on 5 July 2024, or any other date to be determined by Khazanah.
   The timeline provided above is merely indicative, and Khazanah reserves the sole and absolute discretion to amend and modify the same without notice to you.

5. Manner of Submission:
   1. Submissions for the TKM shall be made in video format uploaded and posted on your public Instagram profile (“Entry” or “Entries”).
   2. Each participant may submit only one Entry for each category as listed in paragraph 3 above.
   3. You must ensure that the Instagram profile used for submission of the Entry belongs solely to you, and is made available to be viewed publicly. You must ensure that your Instagram profile remains public during the whole duration of the TKM.
   4. Videos titles posted for submission must include the hashtag #TerokaiKhazanahMalaysia.
   5. Videos posted for submission must include the following three (3) hashtags:
      (i) #TerokaiKhazanahMalaysia;
      (ii) #KisahKitaDariLensa, and
      (iii) #30tahunMemajukanMY or #30yearsAdvancingMY.
   6. Videos posted for submission must mention and tag Khazanah’s official Instagram account: @khazanahnasional.
6. Video Requirements:
   1. Duration of videos submitted shall be at least one 60 seconds, but no more than 90 seconds in length.
   2. Videos submitted shall be in Bahasa Malaysia or English language only and have subtitiles in either language, if necessary or desired.
   3. You should creatively present and explain the national treasure which you have discovered, subject to these video requirements.
   4. You must ensure that the video and caption submitted (i) do not contain and touch on areas or subjects which are sensitive in nature such as religion, race, culture and gender and (ii) must not be insulting or offensive to others.

7. By participating in the TKM, including by submitting your Entries in the manner set out above, you hereby warrant that any and all information submitted by you is true, current and complete, and Khazanah reserves the right to disqualify you if you provide any false data or information.
8. Intellectual Property: Participants, as the original creators of the Entries, will retain complete ownership of the Entries. Notwithstanding the above, the contents used in the TKM by Khazanah, including without limitation, the text, artwork, technology graphics, photos, sounds, videos, interactive features, services and any output thereof found in this website, Khazanah’s social media platforms and throughout the TKM materials (collectively, the “Khazanah Content”) as well as all trademarks, service marks, graphics, logos and marks used in the TKM (“Khazanah Marks”) are owned by Khazanah (Khazanah Content and Khazanah Marks are collectively referred to as (“Khazanah IP”). For the avoidance of doubt, Khazanah shall retain ownership of such Khazanah IP forming part of the Entries, if any. This Agreement does not transfer to you any intellectual property owned by Khazanah, and all rights, titles, and interests in and to such Khazanah IP will remain solely with Khazanah and/or such third-party service providers, where applicable. None of the information published pursuant to the TKM by Khazanah is to be interpreted as granting licenses on the Khazanah IP and the express written consent of Khazanah is to be obtained if you intend on using the Khazanah IP. Unauthorised use of the Khazanah IP are strictly prohibited. You acknowledge that all Khazanah IP are either copyrighted or trademarked as a collective work under applicable intellectual property laws and treaties.
9. Further, you acknowledge and agree that any Entries you submit and all information (including your personal data) may be used by Khazanah for: (i) promoting the TKM and displaying the Entries on Khazanah’s social media platforms, website or any other media forms for its advertising and marketing activities, promotion, publications and/or announcement relating to the TKM or otherwise, (ii) editing, cropping or re-sizing the Entries, (iii) its internal use or (iv) other purposes as Khazanah deems fit.
10. You hereby grant Khazanah a non-exclusive, perpetual and irrevocable license in each Entry for the uses described above.
11. You warrant to Khazanah that, save for Khazanah’s IP which may form part of the Entries, you own all the intellectual property contained in your Entries submitted or to be submitted to Khazanah for the purposes of the TKM, and any use of any information and ideas in your Entries (either used by Khazanah or you) will not infringe any third party’s intellectual property rights, copyright or other legal rights.
12. Conduct of Participants of the TKM: Pursuant to this Agreement, you also agree to not:-
    1. use any part of the Content and Mark without our prior written authorisation or consent, including for commercial and non-private use;
    2. use and make reference to the Content and Mark, which includes the name, logo, trademarks or other intellectual property of Khazanah or any similar derivations; in any material whatsoever without our prior written consent;
    3. use, create derivative works of, transfer (by sale, resale, license, sublicense, download or otherwise), copy, upload, post, publish, adapt, modify, screenshot, reproduce, display, disclose, circulate or distribute the Content or Mark in any way, without our prior written authorisation or consent;
    4. parse any content within the TKM or copy any information or logo used for the purpose of mimicking the look and feel of the TKM;
    5. use the TKM to conduct fraudulent or illegal activities;
    6. use the TKM to collect or harvest information, including without limitation information about the other participants;
    7. engage in any activity that will restrict or inhibit other participants from participating in the TKM peacefully including but not limited to performing any act that would disrupt the TKM;
    8. engage in any activity that is unethical or disruptive to the TKM and other participants participating in the TKM including any activities that abuse, threaten or harass any other participants participating in the TKM, as determined by us;
    9. reverse look-up, trace or seek to trace any information on any other participant in the TKM, or exploit the TKM in any way where the purpose is to reveal any information, including but not limited to personal identification of the other participants without their consent;
    10. use any device, software or routine to interfere or attempt to interfere with the TKM or any of the other participants of the TKM; and
    11. solicit any third party to, violate and infringe any and all applicable laws and regulations that are applicable.
13. Khazanah’s Rights: Khazanah reserves the right to carry out the following in its sole discretion and without having to provide any reason or prior notice to you:-
    1. accept or reject your submissions or Entries in accordance with the TKM eligibility requirements;
    2. disqualify your submissions or Entries at its sole and absolute discretion;
    3. publish, edit, or use your trademarks, logo, data, videos and/or photographs in the TKM publicity materials without any prior notice to you;
    4. compensate the winner(s) with other prizes of similar value without having to assign any reason whatsoever and without any prior notice to you;
    5. at its sole discretion, modify, suspend or discontinue the TKM, temporarily or permanently, or may withdraw your participation in TKM for any reason, with or without notice to you and without liability to you or any third party;
    6. disclose any information we have about you (including your identity) if we determine that such disclosure is necessary in connection with any investigation or complaint regarding the TKM, or to identify, contact or bring legal action against someone who may be causing injury to or interference with (either intentionally or unintentionally) Khazanah’s rights or property, or the rights of other participants in the TKM and in this regard, Khazanah reserves the right at all times to disclose any information that Khazanah deems necessary to comply with any applicable law, regulation, legal process or governmental request and when Khazanah determines that applicable law requires or permits such disclosure, including exchanging information with other companies and organizations for fraud protection purposes; and
    7. amend these terms and conditions at any time and without notice to you.

14. Judging Criteria: Every submission or Entry will be judged based on creativity, originality and how uniquely you are able to capture and present your interpretation of a national treasure. Such works should be relevant to Malaysia’s culture, history or personal significance while having the potential to inspire and evoke a sense of pride to viewers. Your video will be judged on overall production and should hold good quality visuals and storytelling.
15. Prizes: The selected winners for each category will receive:
    1. 1 x Grand Prize: travel vouchers worth RM5,000.00;
    2. 1 x 1st Runner up: travel vouchers worth RM3,500.00;
    3. 1 x 2nd Runner up: travel vouchers worth RM1,500.00 and, 
    4. 2 x Consolation Prize: travel vouchers worth RM500.00.
    In addition, the winning Entries will be exclusively featured on Khazanah’s official platforms.
16. Once the winners have been selected, selected participants are required to send in the following materials within one (1) week’s time:
    1. High-definition Video to be used for announcement purposes etc; and
    2. any other materials as may be requested by Khazanah.
    The selected participants must ensure that the winning Entries are remain posted on Instagram and not deleted within six (6) months from the Winner Announcement date.
17. The prizes are not transferable or assignable. Khazanah reserves the right to substitute or vary the prizes without giving notice or justification to you. The decision of the winners are at the sole discretion of Khazanah. Khazanah’s decision in respect of all matters to do with the TKM will be final and no correspondence will be entertained or entered into.
18. All costs incidental to the redemption and/or usage of the prize(s) shall be solely borne by the selected winners.

19. Administrative processes:
    1. In the event you intend to withdraw your participation in the TKM, you shall notify Khazanah in writing via email at [email protected] at least five (5) working days in advance and you shall immediately cease any and all representation of your participation in the TKM.
    2. Khazanah will attempt to notify the participants of shortlisted Entries by email or Instagram account. Khazanah shall, under no circumstances be responsible and/or liable if any of the shortlisted participant cannot be contacted.
20. No warranty: All information provided in relation to the TKM by Khazanah or its partners is subject to change without notice. Khazanah disclaims any and all liability for the acts, omissions and conduct of any third parties in connection with or related to your participation in the TKM. You assume total responsibility for your participation in the TKM. Your sole remedy against Khazanah for dissatisfaction with the TKM or any content is to withdraw from your participation in the TKM.
21. Liability: You acknowledge by your use of this website and participation in the TKM that such participation is at your sole risk. Khazanah, its affiliates, and Khazanah’s and its affiliates’ partners, shareholders, directors, officers, employees and agents (“Exculpated Parties”) assume no responsibility, and shall not be liable for any damages caused by the TKM to you. In no event shall the Exculpated Parties be liable for any damages of any kind, including without limitation any direct, special, incidental, indirect, exemplary, punitive or consequential damages, including lost profits, whether or not advised of the possibility of such damages, and on theory of liability whatsoever, arising out of or in connection with your participation in the TKM. You also acknowledge that the Exculpated Parties are not liable for the defamatory, offensive or illegal conduct of other participants in TKM or third-parties and that the risk of injury from the foregoing rests entirely with you.
22. Indemnity: You agree to defend, indemnify and hold the Exculpated Parties harmless from and against any and all claims, damages, costs and expenses, including reasonable attorney’s fees, arising from or related to your participation in the TKM. Notwithstanding the indemnification given by you, Khazanah shall have the right to assume the exclusive defence and control of any matter otherwise subject to indemnification by you under the Agreement, and in such case, you agree to fully cooperate as reasonably required with such defence and in asserting any available defences.
23. Laws, Jurisdiction and Disputes: The TKM and the Agreement will be governed by Malaysian law and any disputes will be subject to the exclusive jurisdiction of the courts of Malaysia.
24. Amendment and Modifications: We reserve the right to amend and modify this Agreement, the website or any other terms relating to the TKM at any time at our sole and absolute discretion, without notice to you. An updated version of this Agreement will be effective immediately upon the posting of the revised Agreement, unless otherwise specified. Your continued participation in the TKM after the effective date of the revised Agreement will constitute your consent to those changes.
25. Miscellaneous: If any part of any provision of the Agreement is invalid or unenforceable under applicable law, such part will be ineffective only to the extent of such invalidity or unenforceability, without in any way affecting the remainder of the Agreement. No failure or delay by Khazanah in fully exercising any right, power or privilege will constitute a waiver unless expressly stipulated by Khazanah in writing, and if Khazanah grants a waiver on one occasion, Khazanah shall be entitled to fully enforce its rights, powers and privileges on future occasions. None of the terms in the Agreement shall be enforceable by any person or entity who is not a party to the Agreement. The headings in this Agreement are for convenience of reference only and shall not limit or otherwise affect the meaning hereof.
